The Website is an electronic platform in the form of an electronic marketplace and an intermediary.
The Website provides a platform for Users who are sellers to advertise, exhibit, make available and offer to sell various Products to other Users who are buyers or customers.
The Website provides a platform for buyers or customers to accept offers to sell Products made by sellers on the Website and to make payments to sellers for purchase of Products.
The Website provides services to facilitate the engagement of buyers and sellers to undertake commerce on the Website.
The Website may provide such other services as are incidental and ancillary thereto.

VillagemyCity is the next generation of online classifieds.
We act as a venue to allow our users who comply with these Terms to offer, sell and buy products and services listed on the Platform.
The actual contract for sale is directly between the sellers and buyers.
VillagemyCity is not a traditional auctioneer.
While we may provide pricing, shipping, listing and other guidance in our Services, such guidance is solely informational and you may decide to follow it or not.
While we may help facilitate the resolution of disputes through various programs, VillagemyCity has no control over and does not guarantee the existence, quality, safety or legality of items advertised.
VillagemyCity does not guarantee the truth or accuracy of users' content or listings.
VillagemyCity does not guarantee the ability of sellers to sell items or the ability of buyers to pay for items.
VillagemyCity does not guarantee that a buyer or seller will actually complete a transaction or return an item.
Membership Eligibility
The user should have completed 18 years of age and be competent to enter into a contract under Indian contract law.
The Services are not available to minors under the age of eighteen (18) or to any Users suspended or removed from the VillagemyCity system by VillagemyCity for any reason whatsoever.
If you are a minor, i.e. under 18 years of age, and intend to avail the services of the Website, you should do so through your legal guardian in accordance with applicable law.
VillagemyCity reserves the right to terminate your membership and/or refuse access to use the Services offered at the Website to new Users or to terminate access granted to existing Users at any time without according any reasons for doing so.
You shall not have more than one active Account on the Website.
You are prohibited from selling, trading or otherwise transferring Your Account to another person.
User Account, Password and Security
You may access and use the Website, and You shall be responsible for maintaining the confidentiality and security of the Account Information.

Commercial and contractual terms include, without limitation, price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services, and after-sales services related to products and services.
VillagemyCity does not have any control over, determine, advise or involve itself in the offering or acceptance of such commercial or contractual terms between Buyers and Sellers.
VillagemyCity does not make any representation or warranty as to specifics such as quality, value or saleability of the products or services proposed to be sold, offered to be sold or purchased on the Website.
VillagemyCity does not implicitly or explicitly support or endorse the sale or purchase of any products or services on the Website.
VillagemyCity accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
VillagemyCity is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers.
VillagemyCity cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Website.
VillagemyCity shall not and is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers.
VillagemyCity does not make any representation or warranty as to item specifics, such as legal title, credit worthiness or identity, of any of its Users.
You are advised to independently verify the bonafides of any particular User that You choose to deal with on the Website and use Your best judgment in that behalf.
VillagemyCity does not at any point of time during any transaction between Buyer and Seller on the Website come into or take possession of any products or services offered by Seller.
VillagemyCity does not at any point gain title to, or have any rights or claims over, the products or services offered by Seller to Buyer.
At no time shall VillagemyCity hold any right, title or interest over the products, nor shall VillagemyCity have any obligations or liabilities in respect of any contract entered into between Buyers and Sellers.
VillagemyCity is not responsible for unsatisfactory or delayed performance of services, or damages or delays resulting from products that are out of stock, unavailable or back ordered.
The Website is only a platform that can be utilized by Users to reach a larger base to buy and sell products or services.
VillagemyCity only provides a platform for communication, and it is agreed that the contract for sale of any products or services shall be a strictly bipartite contract between the Seller and the Buyer.
You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance and related matters with the seller(s) that You transact with.
Pricing on any product(s) as reflected on the Website may, due to technical issue, typographical error or product information published by seller, be incorrectly reflected, and in such an event the seller may cancel your order(s).
You release and indemnify VillagemyCity and/or any of its officers and representatives from any cost, damage, liability or other consequence of any actions of Users of the Website.
You specifically waive any claims that you may have in this behalf under any applicable law.
Notwithstanding reasonable efforts, VillagemyCity cannot take responsibility for or control the information provided by other Users which is made available on the Website.
You may find other User's information to be offensive, harmful, inconsistent, inaccurate or deceptive.

Fee
User can use and access the Website free of charge.
VillagemyCity does not charge any fee for browsing and buying the products on the Website.
VillagemyCity reserves the right to change its Fee Policy from time to time.
Changes to the Fee Policy shall be posted on the Website, notifying users in advance.
VillagemyCity reserves its right to charge users for the use of the Website and provision of services through the Website.
All taxes shall be charged as per applicable Indian law.
All fees shall be quoted in Indian Rupees.
Payments Related Information
You are requested to honour your payment obligations to the Company.
Payments for the services offered by the Platform shall be on a 100% advance basis.
The payment for service once subscribed to by you is not refundable and any amount paid shall stand appropriated.
Refund, if any, will be at the sole discretion of the Company.
User hereby irrevocably accepts to receive the tax invoice as soft copy through emails.
Notwithstanding anything contained in any other agreement or arrangement, by whatever name called, the performance obligation of the Company as service provider is to provide access to its online portal to the customer for the duration of the subscription period.
Reference to any usage, by whatever name called, or any other performance obligation, if any, is to provide the upper limit for consumption, which by itself does not create any additional performance obligation upon the Company.
In the event of any suspension or termination of services on account of non-compliance with these Terms of Use, any payment made to the Company by you shall stand forfeited with immediate effect.
While availing any payment method available on the Website, we will not be responsible or assume any liability for any loss or damage arising directly or indirectly due to lack of authorization for any transaction.
We will not be responsible or assume any liability for any loss or damage arising directly or indirectly due to any payment issues arising out of the transaction.
We will not be responsible or assume any liability for any loss or damage arising directly or indirectly due to exceeding the preset limit mutually agreed by You and the bank(s).
We will not be responsible or assume any liability for any loss or damage arising directly or indirectly due to decline of transaction for any other reason.
All payments made against purchases or services on the Website by you shall compulsorily be in Indian Rupees acceptable in the Republic of India.
The Website will not facilitate transactions with respect to any other form of currency for purchases made on the Website.
The User acknowledges and agrees that the Company or Platform, at its sole discretion and without prejudice to other rights and remedies under applicable laws, shall be entitled to set off any excess amount paid by a subscriber or user against any amount payable by User to Company under any other agreement or commercial relationship towards other products or services.
The Company gives no guarantees of server uptime or applications working properly.
All services are on a best-effort basis and liability is limited to refund of amount only.
You understand, accept and agree that the payment facility provided by VillagemyCity is neither a banking nor financial service.
The payment facility is merely a facilitator providing an electronic, automated online payment, receiving payment through collection and remittance facility for transactions on the VillagemyCity Website using existing authorized banking infrastructure and credit card payment gateway networks.
VillagemyCity reserves the right to refuse to process transactions by users with a prior history of questionable charges, including breach of any agreements by user with VillagemyCity Website, breach or violation of any law, charges imposed by issuing bank, or breach of any policy.
Users buying products online are redirected to third-party gateways for completing payment transactions.
These transactions happen on a third-party network and are therefore not controlled by the Company.
A User, through his user identification, shall be solely responsible for carrying out any online or offline transaction involving credit cards, debit cards or such other forms of instruments or documents for making such transactions.
The Company assumes no responsibility or liability for improper use of information relating to such usage of credit cards or debit cards used by the subscriber online or offline.
The Company shall not be liable for any loss or damage sustained by reason of any disclosure, inadvertent or otherwise, of any information concerning the user's account.
The Company shall not be liable for any loss or damage sustained by reason of any disclosure relating to online transactions using credit cards or debit cards, their verification process or particulars.
The Company shall not be liable for any error, omission or inaccuracy with respect to any information so disclosed and used, whether or not in pursuance of a legal process or otherwise.
The User or customer shall be required to promptly provide a copy of TDS certificate to the Company as mandated under law for tax deducted at source from payments made to the Company.
Any loss on account of non-availment or disallowance of such TDS credit due to any lapse by the User or customer, as per this clause or applicable law, shall entitle the Company to seek reimbursement or indemnification.
User shall comply with all applicable laws for using Payment Facility and VillagemyCity Website.
Applicable laws include, without limitation, the Foreign Exchange Management Act, 1999 and related rules and notifications, the Exchange Control Manual issued by the Reserve Bank of India from time to time, the Customs Act, the Information Technology Act, 2000 as amended by the Information Technology (Amendment) Act, 2008, the Prevention of Money Laundering Act, 2002 and related rules, the Foreign Contribution Regulation Act, 1976 and related rules, the Income Tax Act, 1961 and related rules, and the Export Import Policy of the Government of India.
All valid credit, debit, cash card and other payment instruments are processed using a credit card payment gateway or appropriate payment system infrastructure.
Such payment instruments will also be governed by the terms and conditions agreed to between the Buyer and the respective issuing bank and payment instrument issuing company.
All online bank transfers from valid bank accounts are processed using the gateway provided by the respective issuing bank which supports Payment Facility to provide these services to Users.
All such online bank transfers on Payment Facility are also governed by the terms and conditions agreed to between Buyer and the respective issuing bank.
User Conduct and Rules on the Website
The user agrees and undertakes that the reviews, comments and other information provided, posted or uploaded on the Website are not false, incomplete, distorted, manipulated, fraudulent or misleading.
The user agrees, undertakes and confirms that use of or access to the Website shall be strictly governed by the following binding principles.
User will not host, display, upload, modify, publish, transmit, update or share any information or objectionable content that belongs to another person and to which You do not have any right.
User will not share content that is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, racially or ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, misleading, or otherwise unlawful in any manner.

User will not share content that is patently offensive to the online community, including sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred, physical harm, harassment, abusive conduct, threatening conduct, defamation or libel.
User will not transmit junk mail, chain letters, unsolicited mass mailing, spamming, or promote illegal activities.
User will not infringe any patent, trademark, copyright or other proprietary rights, third-party trade secrets, rights of publicity or privacy, and shall not act fraudulently or involve the sale of counterfeit or stolen items.
User will not share software viruses or any computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.
User will not share Trojan horses, worms, time bombs, cancel bots, easter eggs or other computer programming routines that may damage, interfere with, diminish the value of, surreptitiously intercept or expropriate any system, data or personal information.
User will not disrupt or interfere with the security of, or otherwise cause harm to, the Website, system resources, accounts, passwords, servers or networks connected to or accessible through the Website or any affiliated or linked sites.
User will not use the Website or Content for any purpose that is unlawful or prohibited by the Agreement, or to solicit any illegal activity or other activity that infringes the rights of VillagemyCity or other third parties.
User will not try to gain unauthorized access or exceed the scope of authorized access to the Website or to profiles, blogs, communities, account information, bulletins, friend requests or other areas of the Website.
User will not solicit passwords or personal identifying information for commercial or unlawful purposes from other users.
User will not solicit gambling or engage in any gambling activity which We, in Our sole discretion, believe is or could be construed as illegal.
User will not violate any law for the time being in force.
User will not communicate any information that is grossly offensive or menacing in nature.
User will not threaten the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order.
User will not cause incitement to the commission of any cognizable offence, prevent investigation of any offence, or insult any other nation.
User will not falsify or delete any author attributions, legal or other proper notices, proprietary designations, or labels of origin or source of software or other material contained in an uploaded file.
User will not violate any code of conduct or other guidelines that may be applicable for or to any particular Service.
The user shall not use any deep-link, page-scrape, robot, spider or other automatic device, program, algorithm, methodology, or any similar or equivalent manual process to access, acquire, copy or monitor any portion of the Website or any Content.
The user shall not reproduce or circumvent the navigational structure or presentation of the Website or any Content to obtain, or attempt to obtain, any materials, documents or information through any means not purposely made available through the Website.

Applicable laws and regulations include, but are not limited to, Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty and Local Levies regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services.
You shall not engage in any transaction in an item or service that is prohibited by the provisions of any applicable law, including exchange control laws or regulations for the time being in force.
You may need to install updates introduced by us or any third party from time to time to use the services, Products, Website, downloads and required functionality.
Updates may include bug fixes, patches, enhanced functions, missing plug-ins and new versions.
